El Tribunal Unificado de Patentes acuerda las primeras medidas cautelares respecto de una patente europea validada en España: consideraciones críticas

La Resolución de la División Local de Hamburgo del Tribunal de Primera Instancia del Tribunal Unificado de Patentes de fecha 14 de agosto del 2025 adopta las medidas cautelares porque se considera competente para conocer del fondo del asunto (tanto de la infracción de la patente unitaria en los Estados parte del Acuerdo por el que se crea el Tribunal Unificado de Patentes como de la validación española de la patente europea que es base de la patente unitaria). Y a tal efecto el tribunal hace una serie de consideraciones no siempre acertadas sobre su competencia judicial internacional.
