El TEAC vuelve a manifestarse sobre el alcance del carácter vinculante de los informes del Ministerio de Ciencia e Innovación sobre deducciones por actividades de I+D e IT

El Tribunal Económico-Administrativo Central analiza de nuevo el alcance del carácter vinculante de los informes del Ministerio de Ciencia e Innovación sobre la deducción por actividades de investigación y desarrollo e innovación tecnológica, regulada en el artículo 35 de la Ley 27/2014, y concluye que tal vinculación alcanza a la calificación de la actividad ―de innovación tecnológica en este caso―, pero no a los gastos que integran la base de la deducción, por lo que éstos podrán ser regularizados por la Inspección tributaria ―en este caso, sobre la base del informe emitido por el equipo de apoyo informático de la Administración―.
