El deudor que aporta sus bienes a una empresa de su exclusiva titularidad no comete delito de alzamiento de bienes

La Sentencia 457/2023, de 14 de junio, de la Sala Segunda del Tribunal Supremo indica que no constituyen delito de alzamiento de bienes aquellos actos de disposición del deudor sobre sus activos cuando éste obtiene una contraprestación que reequilibra su situación financiera.
