El control de las horas extraordinarias no justifica el control de la jornada ordinaria

Las empresas no están obligadas a registrar la jornada ordinaria pese al requerimiento de anotar las horas extraordinarias realizadas. Ésta es la conclusión de una reciente sentencia del Tribunal Supremo que, aunque controvertida a juzgar por los votos particulares que la acompañan, anula la decisión adoptada en el 2015 por la Audiencia Nacional y relativiza los protocolos de actuación desarrollados por la Inspección de Trabajo y Seguridad Social en esta materia.Admite este pronunciamiento que, de lege ferenda, sería conveniente aclarar la obligación de llevar un registro horario, pero la norma vigente no exige controlar la jornada diaria efectiva de toda la plantilla para comprobar el cumplimiento de los horarios pactados…
