El Caso Rator: interpretación judicial de la excepción del artículo 682.2 TRLC

La sentencia del Caso Azor considera que no es necesario que la pyme forme parte del perímetro de consolidación para la aplicación de la excepción prevista en el artículo 682.2 de la Ley Concursal. Dicho criterio supone un espaldarazo definitivo a la reforma de la ley concursal, evitando la puesta en práctica de estructuras societarias artificiosas que no tuvieran otra finalidad que bloquear la homologación de planes de reestructuración no consensuales.
