El alcance de la estimación de un recurso jurisdiccional sobre la base de la inconstitucionalidad del Real Decreto Ley 3/2016

El alcance de la Sentencia de la Audiencia Nacional recaída en el recurso núm. 1102/2022 es claro y abarca tanto la anulación del acuerdo desestimatorio de la solicitud de rectificación de autoliquidación y de la resolución del tribunal económico-administrativo que lo confirma como el reconocimiento del derecho del recurrente al restablecimiento de su situación jurídica individualizada.
