Denominación de una variedad vegetal y uso descriptivo de una marca ajena

Es indudable que la denominación registrada de una variedad vegetal puede ser empleada por cualquiera que comercialice material vegetal de dicha variedad. Sin embargo, en el caso concreto llama la atención la afirmación del Tribunal Supremo de que «el uso del término Persimmon empleado por la demandada lo fue para identificar una determinada variedad de caqui».
