Partiendo de la importancia económica de la compra pública y de su configuración como instrumento idóneo para la implementación de políticas con trascendencia social, las Directivas Europeas de 2014 y la legislación española que las traspone, han dado carta de naturaleza a la Compra Pública Estratégica. La puesta en práctica de este instrumento enfrenta la dificultad de incorporar cláusulas sociales como criterios de adjudicación. Una muy reciente resolución del Tribunal Administrativo Central de Recursos resume las reglas aplicables al respecto.
