El Tribunal Supremo interpreta, en su reciente STS 1914/2024, la causa de resolución del contrato de obras por suspensión de la ejecución del contrato por plazo superior a ocho meses acordada por la Administración en lo concerniente a su operatividad. Señala al respecto la Sentencia que la suspensión de las obras durante un periodo superior a 8 meses acordada por la Administración es un supuesto de carácter objetivo, pero no por ello opera con carácter automático, siendo preciso atender cada caso concreto.
