Caducidad de la acción contra el responsable del defectuoso aseguramiento («trincaje») de la mercancía en el transporte marítimo

El plazo de ejercicio de la acción que corresponde al cargador contra el transitario o sus auxiliares por daños en la mercancía ocasionados por defectuosa estiba o sujeción de la carga es el de un contrato de trasporte marítimo, y no el establecido en general en el Código Civil para el contrato de obra.
