Existe un «derecho de información pasiva» que obliga a la empresa a proporcionar a las organizaciones sindicales información que constituye contenido esencial de la libertad sindical, entre otros aspectos, sobre los algoritmos o herramientas de inteligencia artificial. Mas no siempre se trata de una nueva fórmula de fijación de la organización productiva, sino de herramientas más sofisticadas de determinación, que no requerirían información plena sobre su utilización.
