Europe strengthens its rules to safeguard free competition in times of crisis | Jornal de Negócios

Joaquim Caimoto Duarte, Counsel for Competition and EU Law and current President of ICC Portugal, discusses in this interview the role of regulation and specialised courts in addressing global challenges and European interventionism.

Joaquim highlights the importance of free competition as a driving force for innovation and consumer protection, particularly during periods of crisis and international rivalry.

He points out that Portugal enjoys an advantage thanks to its specialised court, which brings coherence and agility to decision-making. He also comments on how, within the European Union, the strengthening of intervention in strategic sectors aims to enhance competitiveness against global rivals, without slipping into protectionism.

The expert further warns of the challenges posed by artificial intelligence, stressing the need for vigilance to prevent excessive concentration within technological platforms.

Court of Justice rules that lower courts may disregard decisions of higher courts that violate independence and impartiality
The Court of Justice ruling of 4 September 2025 (C-225/22) has declared that national courts may set aside decisions of higher courts that do not comply with the requirements of independence and impartiality derived from Article 19(1) of the Treaty on European Union and Article 47 of the Charter of Fundamental Rights of the European Union.

Prohibition of arbitration in the single energy market
The Agreement on the interpretation and application of the Energy Charter Treaty gives the force and effect of law to the case law of the Court of Justice of the European Union, according to which Article 26 of the Energy Charter Treaty does not and could not apply as a legal basis for intra-EU arbitration proceedings as a mechanism for the settlement of disputes between a contracting State and an investor of another contracting State.

Offsetting employment claims: can a company offset them unilaterally?
If a collective action is brought to challenge the unilateral conduct of a company in the offsetting of salary claims through a payroll deduction, the amount of the debt and the existence of quantitative discrepancies must necessarily be questioned in order to be able to assess whether or not there is legal offsetting on the part of the employer. Only by admitting that the debt is a liquidated amount that is due and payable will the employer - or the employee, as the case may be - be able to offset the debt, but if the debt is not disputed, the way is open for the offsetting of wage claims.

Modification of concession when concessionaire no longer has in-housestatus: the CJEU clarifies when a new award procedure is not required
The Judgment of the Court of Justice of the European Union of 29 April 2025 addresses the modification of public contracts originally awarded to an in-house entity which, during performance of the contracts, has lost such status. The reference for a preliminary ruling was made in the context of a dispute concerning the extension of concession contracts relating to service facilities ancillary to motorways to include the construction, maintenance and operation of fast-charging infrastructure.
