El Mundo publica um artigo sobre a altera\u00e7\u00e3o da prioridade das conven\u00e7\u00f5es colectivas em Espanha.<\/h4>\n\n\n\n

Esta altera\u00e7\u00e3o, que favorece os acordos regionais em detrimento dos nacionais, cria um espa\u00e7o para a negocia\u00e7\u00e3o de certas quest\u00f5es, anteriormente vetadas aos acordos regionais, como os sal\u00e1rios, os turnos ou o hor\u00e1rio m\u00ednimo de trabalho. Estas condi\u00e7\u00f5es podem ser regulamentadas desde que sejam melhores do que as regulamentadas no acordo estatal.<\/p>\n\n\n\n

No entanto, devido ao car\u00e1cter repentino da mudan\u00e7a, esta gera um clima de incerteza e instabilidade, uma vez que implica uma rutura na unidade do mercado. Al\u00e9m disso, pode levar \u00e0 inseguran\u00e7a jur\u00eddica porque, \u00e0 medida que os acordos s\u00e3o renovados, as empresas podem encontrar-se em condi\u00e7\u00f5es diferentes consoante o seu territ\u00f3rio.<\/p>\n\n\n\n

Lourdes Escassi, advogada da Laboral de G\u00f3mez Acebo & Pombo, explica: “A prioridade do acordo coletivo de trabalho regional e provincial sobre o acordo coletivo de trabalho estatal \u00e9 preocupante, uma vez que conduz a um duplo dilema para as empresas. Por um lado, incentiva a adapta\u00e7\u00e3o da contrata\u00e7\u00e3o colectiva \u00e0 realidade de cada territ\u00f3rio e, por outro lado, o impacto que essa prioridade pode ter na unidade do mercado espanhol, uma vez que as empresas podem ser penalizadas por um aumento dos custos laborais em fun\u00e7\u00e3o do local onde decidem estabelecer as suas opera\u00e7\u00f5es”.<\/p>\n\n\n\n
