\r\nO ac\u00f3rd\u00e3o, proferido em 23 de abril de 2024, declara que a He\u00fcra cometeu actos de concorr\u00eancia desleal, uma vez que a sua publicidade, constitu\u00edda por afirma\u00e7\u00f5es relativas ao gado e aos produtos de carne, \u00e9 enganosa, denegridora e constitui uma compara\u00e7\u00e3o il\u00edcita.
\r\n
\r\nO que \u00e9 relevante nesta senten\u00e7a \u00e9 a condena\u00e7\u00e3o da He\u00fcra, que afirma que a publicidade declarada il\u00edcita foi realizada atrav\u00e9s de uma intensa campanha na rede social Instagram, bem como a faixa publicit\u00e1ria na rua Toledo, em Madrid (Um hamb\u00farguer polui mais do que o seu carro). Apesar do banner ter sido retirado, o autor da a\u00e7\u00e3o provou no seu processo que a a\u00e7\u00e3o chegou mesmo a \u201clucrar\u201d com o anterior procedimento cautelar, com a publica\u00e7\u00e3o de fotografias e v\u00eddeos. Assim, n\u00e3o se pode excluir que a conduta da r\u00e9 continue ou que os atos enganosos, denegridores e ilicitamente comparativos permane\u00e7am na mem\u00f3ria do consumidor.
