Companies affected by Storm Kristin may temporarily assign employees duties other than those originally agreed, under the functional mobility rules set out in Portuguese labour law. However, this possibility is not without limits.<\/p>\n\n\n\n

Madalena Caldeira, partner at G\u00f3mez-Acebo & Pombo, underlines that \u201ca possibilidade de o empregador encarregar o trabalhador de exercer fun\u00e7\u00f5es diferentes daquelas para as quais foi contratado n\u00e3o \u00e9 ilimitada\u201d. For the order to be lawful, she explains, \u201co exerc\u00edcio das novas fun\u00e7\u00f5es deve ser tempor\u00e1rio (n\u00e3o superior a dois anos) e a ordem de altera\u00e7\u00e3o tem de ser fundamentada em interesse s\u00e9rio da empresa, de car\u00e1ter objetivo e relacionado com situa\u00e7\u00f5es an\u00f3malas na vida da empresa\u201d.<\/p>\n\n\n\n
